5.1 You acknowledge that the Products or Services displayed on the Website or other Service are an invitation to treat and that your order for any Product(s) or Service(s) is an offer to purchase such Product(s) or Service(s). All orders are subject to our acceptance and availability. Items placed in your shopping cart are not reserved and may be purchased by other customers. We will inform you if we cannot fulfill your order.
5.2 We may, at our discretion, refuse to accept your order for any reason without liability to you. Examples include inability to obtain payment authorization; shipping restrictions on particular items or services; the ordered item is out of stock; the item does not meet our quality standards and is withdrawn; or you do not meet eligibility criteria established in these Terms.
5.3 We are legally obligated to supply products and Services as described on the Website.
5.4 We may also refuse to process (and therefore accept) a transaction for any reason at any time, at our sole discretion. This includes refusing to process a transaction or canceling or suspending any transaction once processing has begun.
5.5 After placing an order, we will send you a confirmation email including your order number, details of the items you ordered, and delivery information. Please note that this email is an acknowledgment of your order, not an acceptance.
5.6 Acceptance of your order and formation of a sales contract occurs when we have sent your order and issued a confirmation email.
5.7 When placing an order for the first time, you may be asked or offered the option to register with us and complete certain mandatory fields in an order form. When requested to use identifiers and passwords for access to restricted parts of the Website, you are responsible for keeping them secure and confidential at all times. You must comply with all security instructions we provide and notify us immediately if you become aware of or suspect any unauthorized use of your account.
5.8 Order status is typically updated within one hour, but no guarantee is made regarding functionality or uptime.
5.9 Payment will be debited from your card at the time the order is placed.

6. Prices

6.1 The prices displayed on the Website in USD do not include VAT or sales tax. Prices shown in GBP and Euros include VAT. Shipping costs are not included.

6.2 All prices and offers remain valid as advertised at the time. The price in pounds, Euros, or dollars of a product shown on the website at the moment of order acceptance will be honored, except in cases of obvious error.

7. Payment

7.1 Payment can be made with Visa, MasterCard, and American Express. Payment will be debited and credited to your account once the order process on the website or other service is complete. You may also use Apple Pay, which eliminates the need to enter your credit card details. When selecting this option at checkout, you will be directed to the associated site to log in to your account and review the total amount before clicking “Pay Now.” Once you click “Pay Now” and return to the website, your transaction will be complete. We bear no responsibility regarding the terms and conditions agreed upon between you and PayPal, Google Pay, Amazon Pay, or any other payment intermediary.

7.2 You confirm that the credit/debit card, PayPal account, or other payment intermediary account being used belongs to you, or that you have been expressly authorized by the owner to use it. All cardholders are subject to validation and authorization checks by the card issuer. If your card issuer refuses to authorize the payment, we will not be responsible for any delay or non-delivery.

7.3 To help ensure your shopping experience is secure, we (or our external payment processors, as applicable) use industry-standard security systems to encrypt your payment data and protect against unauthorized access.

7.4 You may save credit card details in your account for completing future orders. For your security, you will always be asked to enter your CVV code at checkout. Authorization to charge your account is received once the order is placed, and the pending transaction will be settled upon shipment. For security and fraud prevention purposes, all orders made with a credit or debit card are subject to authorization, and our fraud team may request additional details before processing an order.

7.5 We reserve the right to cancel your purchase without prior notice. Examples of situations in which we may choose to cancel your purchase include: your card details being flagged by our fraud detection processes or rejected by our fraud screening process.

7.6 We also take reasonable precautions, to the extent within our control, to keep your order and payment details secure. However, to the fullest extent permitted by law, and in the absence of negligence on our part, we cannot be held responsible for any loss you may suffer if a third party gains unauthorized access to any data you provide while accessing or placing an order on the website. 8. Delivery

8.1 Our delivery and returns partner, Port Logistics Group, will deliver your purchases via FedEx or DHL. If you choose standard shipping, DHL may hand off your package to a local courier outside of the DHL network.

8.2 Ownership of any product you have ordered will pass to you upon delivery at the date and time to the address you provided.

9. Shipping

9.1 Once your order is shipped, we will send you a confirmation email including your tracking number. You can track your order using this link. Order status is typically updated within an hour of processing, though exact functionality and timing cannot be guaranteed.

9.2 When placing your order, please ensure your billing and shipping details are correct, as packages cannot be redirected once processed. You are responsible for any inaccurate or incomplete information provided.

10. Costs and Delivery Times

10.1 Deliveries are made from Monday to Friday, except on public holidays. Unless otherwise indicated on the website, delivery times, costs, and other details are provided below.

10.2 In Spain:

  • 10.2.1 Standard Shipping: 3–7 business days: €5. Orders of €50 or more qualify for free standard shipping if the customer is a member of the The M-Suite loyalty program.

  • 10.2.2 -Day Shipping: Place your order before 1:00 p.m. Spanish time: €5

  • 10.2.3 Next-Day Shipping: Place your order before 1:00 p.m. Spanish time: €25

10.3 In the United Kingdom:

  • 10.3.1 Standard Shipping: 4–10 business days: €5. Orders of €50 or more qualify for free standard shipping if the customer is a member of the The M-Suite loyalty program.

  • 10.3.2 Express Shipping: 3–7 days, if ordered before 1:00 p.m. Spanish time: €15

  • 10.3.3 Priority Shipping: 2–4 days, if ordered before 1:00 p.m. Spanish time: €25

10.4 Delivery times are estimated and begin from the shipping date. We will make every effort to dispatch your order as quickly as possible, but we are not responsible for delays resulting from remote delivery locations or adverse weather conditions.

11 Returns

11.1 When placing an order on malenaesenciaestilo.com, you may return any program or item within 15 days of delivery. The customer is responsible for covering the cost of return shipping or any other related expenses.

11.2 Items must be returned in their original condition. Returns that have been used, altered, or damaged will not be accepted and may be returned to you or a refund may be denied.

11.3 Products must be returned unused, unopened, and in their original packaging, or they will not be accepted.

11.4 You are responsible for all products until they are returned to us. We are not liable for loss during the return shipment. We recommend using a traceable shipping method and keeping a record of your tracking number.

11.5 Once items are received, they will undergo a quality review. Upon approval, you will receive a refund for the purchase price (excluding original shipping costs) directly to the original payment method used. We strive to process refunds as soon as we receive the items, but please allow 5–10 business days for returns to be processed. You will receive an email notification regarding your refund status once it has been completed.

11.6 We do not refund the initial shipping costs for returned items, except in the case of defective products. Your own return shipping costs are non-refundable.

11.7 Nothing in these Terms affects your right to return products under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, or any equivalent or replacement law.

12. Refunds

To ensure the highest quality in our services, we’ve designed a refund policy that reflects our commitment to excellence, respect for your time, and professionalism in everything we do.

12.1. For Coaching Sessions and Personalized Programs

✦ Cancellations and Rescheduling:

  • If you need to cancel or reschedule your session, you may do so at least 48 hours in advance without penalty.

  • Cancellations made with less than 48 hours’ notice will not be refundable, but may be rescheduled depending on availability.

  • If you do not attend your session without prior notice, it will be considered as completed and no refund will be issued.

✦ Coaching Packages and Long-Term Programs:

  • If you purchase a package of sessions or a full program and decide not to continue, no refunds will be made for sessions already taken or scheduled.

  • In exceptional cases, a credit may be offered toward other services, subject to evaluation.

12.2. For Pre-Recorded Programs and Digital Content

  • Due to the digital nature of our programs, once payment has been completed and access granted, returns or refunds will not be accepted.

  • If you feel the content does not meet your expectations, please contact us within 7 days to explore a personalized solution.

  • We are committed to providing valuable content aligned with our philosophy of excellence. If you believe there is an issue with access or content quality, please reach out to us and we’ll gladly resolve it.

12.3. For Third-Party Product Recommendations

✦ Responsibility of Each Brand:

  • At Malena Essence & Style, we share carefully curated recommendations of luxury and wellness products, but we do not handle direct sales.

  • Any purchase made through our recommendations is subject to the return and refund policy of the respective brand.

  • For refund inquiries in such cases, we suggest contacting the vendor directly.

12.4. Exceptions and Special Circumstances
